Most DUI attorneys file the same boilerplate pre-trial motions and hope for ARD.  The motion is the same Word document that has been on their computer for a decade.  I dig deeper because Bucks County prosecutors and judges have seen these cookie-cutter motions 1,000 times.

Here’s what they don’t normally see:

Traffic Stop Defense

The police report says: “the defendant was weaving within the lane and crossing the fog line.”

What I Do: I pull the dashcam footage and view it frame-by-frame.  I show the car touched the white line twice in 3 miles of driving on a dark, winding road.  That’s not erratic driving, that’s normal driving.

Pennsylvania law says an officer needs probable cause or reasonable suspicion of criminal activity or a traffic violation to stop your car.  Perfectly legal driving with minor, isolated lane deviations, doesn’t cut it.  Motion to Suppress filed.  Without a legal stop, there’s no case.

Field Sobriety Tests Were Designed to Fail

The police report says: “the defendant failed the one-leg-stand, walk-and-turn and HGN tests.”

What I ask the officer in court:

  • “Where exactly did you conduct these tests?” (Answer: unlight gravel shoulder of Old Easton Road)
  • “What did my client tell you about his medical history?” (Answer: bad knee from prior surgery)
  • “Did you offer to conduct the tests on level pavement?”  (Answer: no)
  • “Are you certified as a drug recognition expert?”  (Usual answer: no, DRE certification requires 120 hours training)
  • “How many hours of training do you have in conducting field sobriety tests?”  (Usual answer: completed ARIDE=12 hours training)
  • “How many DUI arrests have you made?”  (Common answer: less than 20)

These tests are difficult for a sober person to complete under perfect conditions.  On a darkened shoulder of a road?  They’re impossible.  That’s not evidence of impairment, that’s evidence of a flawed, unreliable test.

Blood Test Challenges

The police report says: “Blood drawn at Doylestown Hospital at 1:47 a.m.”

What I investigate:

  • Who drew the blood? (Not all phlebotomists are certified for legal blood draws)
  • What time did the blood tube actually reach the lab (usually NMS)?  (Chain of custody gaps are common in late-night blood draws)
  • Was the blood stored at the correct temperature?
  • What’s the margin of error on the specific blood testing equipment?

Blood tests can be wrong.  I’ve seen improper handling, contamination, and faulty equipment.  If the blood test is the only evidence against you (and it sometimes is) these challenges matter.

Constitutional Violations
